ARTICULO 18. El artículo 88 del Código Contencioso Administrativo quedará así: "Artículo 88. ACCIÓN DE DEFINICIÓN DE COMPETENCIAS ADMINISTRATIVAS. Los conflictos de competencias administrativas se promoverán de oficio o a solicitud de parte. La entidad que se considere incompetente remitirá la actuación a la que estime competente; si ésta también se declara incompetente, ordenará remitir la actuación al Tribunal correspondiente o al Consejo de Estado. Recibido el expediente y efectuado el reparto, el Consejero Ponente dispondrá que se dé traslado a las partes por el término común de tres (3) días, para que presenten sus alegatos; vencido el término de traslado, la Sala Plena debe resolver dentro de los diez (10) días. Si ambas entidades se consideran competentes, remitirán la actuación al correspondiente Tribunal o al Consejo de Estado y el conflicto será dirimido por el procedimiento prescrito en el inciso anterior".
