ARTICULO 1 º El artículo 40 del Código Contencioso Administrativo quedará así: "Artículo 40. SILENCIO ADMINISTRATIVO. Transcurrido el plazo de dos (2) meses, contado desde la fecha de presentación de una petición sin que se haya notificado decisión que la resuelva, se entenderá que ésta es negativa. La ocurrencia del silencio administrativo negativo implica pérdida de la competencia para resolver la petición. Contra los actos presuntos, provenientes del silencio administrativo, no procederá ningún recurso por la vía gubernativa. Pero se deberá investigar la posible falta disciplinaria del funcionario u órgano que omitió resolver".
