ARTICULO 41. FRACASO DEL INTENTO DE CONCILIACION. En cualquier momento en que una de las partes manifieste al funcionario que el acuerdo no es posible, aquél dará por terminado el intento de conciliación y declarará ésta fracasada, en un acta en que consignará previamente las pretensiones de las partes, los hechos que las fundamentan y las pruebas aportadas por ellas. El acta será firmada por las personas indicadas en el artículo 37 de este Decreto.
