El tribunal superior rechazará de plano el recurso de anulación cuando aparezca manifiesto que su interposición, es extemporánea o cuando las causales no correspondan a ninguna de las señaladas en el artículo anterior. En el auto por medio del cual el tribunal superior aboque el conocimiento ordenará el traslado sucesivo por cinco (5) días al recurrente para que lo sustente y, a la parte contraria para que presente su alegato. Los traslados se surtirán en la secretaría.
