En cumplimiento del

Parágrafo 2

del artículo 37 de la Ley 135 de 1961, modificada por la Ley 30 de 1988, los adjudicatarios de baldíos, dentro de los cinco (5) años siguientes a la adjudicación solamente podrán hipotecarlos para garantizar obligaciones de crédito de fomento a favor de entidades financieras. Para tal fin a la correspondiente minuta de hipoteca deberá anexarse autorización expedida por el INCORA sobre la viabilidad del gravamen, atendidas la calidad del acreedor hipotecario y la modalidad del crédito.
