PROCEDIMIENTO OFICIOSO. El reconocimiento de las prestaciones sociales a que tienen derecho los Oficiales y Suboficiales de las Fuerzas Militares o sus beneficiarios, será tramitado oficiosamente por el Ministerio de Defensa o por la Caja de Retiro de las Fuerzas Militares, según el caso. Cuando las Oficinas de Personal no puedan producir de oficio las pruebas relacionadas en este título, corresponde allegarlas al interesado y si no existiere la prueba principal, será reemplazada por la prueba supletoria que admita la ley.
