SANCIONES POR INJUSTIFICADA DESAPARICION. Si el Oficial o Suboficial apareciere en cualquier tiempo y no justificare su desaparición, tanto él como quienes hubieren recibido sueldos o las prestaciones por muerte si fuere el caso, tendrán la obligación solidaria de reintegrar al Tesoro Público las sumas correspondientes, sin perjuicio de la acción penal a que hubiere lugar.
