RETIRO POR CONDUCTA DEFICIENTE. Los Oficiales y Suboficiales de las Fuerzas Militares serán retirados en cualquier tiempo del servicio activo por conducta deficiente en los siguientes casos

Cuando su clasificación anual sea en lista número 5 de acuerdo con el Reglamento de Evaluación y Clasificación para el personal de las Fuerzas Militares, en virtud de haber sufrido varias sanciones disciplinarias;

Cuando en cualquier tiempo y de acuerdo al Reglamento de Evaluación y Clasificación para el Personal de las Fuerzas Militares, la evaluación del indicador de "moral" lo lleve a ser clasificado en lista número 5.
