CONCORDANCIA DE LA SENTENCIA CON EL VEREDICTO. En los procesos con intervención del jurado, el dictar la sentencia de acuerdo con el veredicto, con la resolución de acusación, con las pruebas aportadas en el juicio y con el debate oral de la audiencia pública. Podrá, por tanto, variar la denominación del delito dentro del género del capitulo correspondiente del Código Penal y declarar cualquier otra circunstancia modificadora de la culpabilidad y de la punibilidad. En todo caso se consignarán con claridad las razones que el juez ha tenido para acoger o rechazar los planteamientos del debate oral.
