VARIACION DE LA CALIFICACION PROVISIONAL. Cuando de las diligencias practicadas en el término probatorio del juicio en la audiencia pública, varíe la adecuación típica del hecho punible, dentro del correspondiente Título del Código Penal, el juez dictará el fallo con base en dicha variación. En este caso la audiencia se suspenderá por el término de dos (2) días para que las partes soliciten las pruebas que tengan relación con la nueva adecuación. La anterior determinación se tomará por auto de Sustanciación motivado, una vez que se hayan practicado las pruebas.
