LIBERTAD INMEDIATA POR CAPTURA O PROLONGACION ILEGAL DE PRIVACION DE LA LIBERTAD. Cuando la captura se produzca o prolongue con violación de las garantías constitucionales o legales, el juez a cuya disposición se encuentre el capturado, ordenará inmediatamente su libertad. Lo dispuesto en el inciso anterior también se aplicará cuando la persona sea aprehendida en flagrancia por hecho punible que exigiere querella y ésta no se hubiere formulado. La persona liberada deber firmar un acta de compromiso en la que conste nombre, domicilio, lugar de trabajo y la obligación de concurrir ante la autoridad que lo requiera.
