FUNCIONARIO COMPETENTE PARA DICTAR AUTO CABEZA DE PROCESO. El juez que haya hecho directamente la indagación preliminar o que haya dirigido la realizada por el Cuerpo Técnico de Policía Judicial, es el funcionario competente para dictar auto cabeza de proceso o auto inhibitorio. En caso de que dicte auto cabeza de proceso hará toda la Instrucción del sumario, excepto si se trata de Juez de Instrucción permanente. Lo dispuesto en el inciso primero no se aplicará cuando de cual se enviará al funcionario o corporación correspondiente para que decida sobre la apertura de la investigación.
