DURACION DE LA INDAGACION PRELIMINAR. La indagación preliminar cuando exista persona identificada, sólo podrá extenderse por un término máximo de quince (15) días más el de la distancia, vencido el cual el juez determinará, si es del caso, abrir investigación o dictar auto inhibitorio. Cuando no exista prueba de identificación o de individualización del posible autor o participe del hecho, el juez determinará las pruebas que sean necesarias para tal fin, las que se llevarán a cabo en un término máximo de sesenta (60) días, directamente por el Juez o mediante comisión. Si antes del vencimiento de este término se aportaren pruebas de identificación o individualización del autor o participe del hecho, el juez decidirá si abre o no investigación.
