VERSION DEL IMPUTADO EN INDAGACION PRELIMINAR. Cuando sea indispensable tomar versión al imputado durante la indagación preliminar, para efectos de la identificación del autor o participe del delito o para determinarse si existió el hecho, o si este es violatorio de la ley penal, dicha versión sólo podrá ser recibida por el juez instructor y con la asistencia del defensor. Sólo podrá recibirse versión del imputado sin asistencia del defensor, en los mismos casos en que la ley lo permita para la diligencia de indagatoria. La aceptación del hecho por parte del imputado en la versión rendida dentro de la investigación preliminar, tendrá valor de confesión. El imputado podrá solicitar que se le reciba versión.
