PROVIDENCIAS CONSULTABLES. Son consultables, cuando contra ellas no se hubiere interpuesto recurso de apelación, las siguientes providencias

La sentencia y el auto de cesación de procedimiento, cuando el delito porque se procede tuviere señalada pena privativa de la libertad cuyo máximo exceda de cinco (5) años.

La providencia por medio de la cual se concede la libertad condicional, cuando la pena impuesta sea mayor de cinco (5) años. No habrá lugar a consulta, en los casos anteriores, cuando la providencia ha sido notificada personalmente al procesado o su defensor, o cuando haya parte civil reconocida.
