DEFINICION. Tercero Incidental es toda persona, natural o jurídica, que conforme al régimen de Derecho Penal y Civil, sin estar obligada a responder patrimonialmente por razón del hecho punible, tenga un derecho económico afectado dentro del proceso. El tercero incidental podrá personalmente o por intermedio de abogado, ejercer las pretensiones que le correspondan dentro del proceso penal.
