El Ministerio Público en la rama penal se ejerce por el Procurador General de la Nación, por los Delegados en lo Penal, por los Fiscales de los Tribunales Superiores de Distrito Judicial, por los Agentes Especiales que designe el Procurador General de la Nación, por los Fiscales de los Juzgados Superiores y de los Juzgados de Circuito y por los Personeros Municipales. La Cámara de Representantes ejerce determinadas funciones fiscales.
