SANCION AL FUNCIONARIO QUE OMITA DECLARARSE IMPEDIDO. Cuando prospere la causal de recusación, se impondrá al juez que no se declaró impedido, dentro del término de que trata el Artículo 105, una multa hasta el equivalente a un mes de salario, impuesta de plano por su respectivo superior jerárquico, sin perjuicio de las acciones penales y disciplinarias a que haya lugar. Si se tratare de magistrado de la Corte Suprema de Justicia, la sanción será impuesta por los demás miembros de la Sala.
