CONTINUACI0N DE LA INSTRUCCION Y SUSPENSION DEL JUICIO. Desde cuando se presente la recusación, o se manifieste el impedimento, hasta cuando se resuelva definitivamente el incidente, se suspenderá el proceso. Pero si se hallare en etapa de sumario, podrán ejecutarse los actos de instrucción. Lo referente a la definición de situación jurídica o a la libertad del procesado, será resuelto por el juez que tenga el proceso en el momento que se formule la solicitud.
