PROCEDIMIENTO. La colisión puede ser provocada de oficio o a solicitud de parte. Quien la proponga se dirigirá al otro juez o Tribunal ante quien se promueva, exponiéndole los motivos que tiene para conocer o no del caso concreto. Si este juez o magistrado no lo aceptare, contestar dando la razón de su renuencia, y en tal caso dará cuenta al juez o Tribunal inmediatamente superior para que, dentro de los tres (3) días siguientes, decida de plano la colisión. Los Tribunales Superiores dirimirán el conflicto en sala de decisión.
