PROCEDENCIA. Salvo las excepciones legales, a partir de la ejecutoria de la resolución de acusación o del auto sobre control de legalidad, habrá lugar a la acumulación de procesos penales, en las siguientes situaciones

Cuando contra una misma persona se estuvieren siguiendo dos o más procesos aunque en estos figuren otros procesados.

Cuando estén cursando dos o más procesos penales y no pueda decidirse sobre uno de ellos, sin que se haya fallado el otro u otros.
