EMPLAZAMIENTO Y NOMBRAMIENTO DE APODERADO. Si el demandado no compareciere en la fecha señalada o no fuere posible la citación, previo informe del notificador rendido bajo juramento, se le emplazar de la siguiente manera: se fijará edicto por el término de cinco (5) días, vencidos los cuales se le declarará persona ausente y se le designará apoderado con quien se surtirá la notificación.
