EFECTOS DE LA COSA JUZGADA PENAL ABSOLUTORIA. La acción civil no podrá iniciarse ni proseguirse cuando en el proceso penal se haya declarado, por providencia en firme, que el hecho causante del perjuicio no se realizó o que el sindicado no lo cometió o que éste obró en cumplimiento de un deber o en legitima defensa.
