DESISTIMIENTO DE LA ACCION. El querellante podrá desistir de la acción penal, con el consentimiento del procesado, mediante manifestación escrita presentada ante el Juez. Si se tratare un incapaz, el desistimiento deberá ser autorizado por su representante legal o por el defensor de menores o el Agente del Ministerio Publicó que hubiere coadyuvado la querella. El desistimiento presentado en favor de un procesado comprende a los demás que lo acepten.
