Cuando un municipio o el Distrito Especial de Bogotá se encuentre en mora del pago de alguna obligación contraída con otra entidad pública, esta podrá solicitar al Ministerio de Hacienda y Crédito Público que, para pagar dichas deudas, realice las retenciones necesarias sobre el incremento de la participación en el impuesto a las ventas que dispuso la Ley 12 de 1986.
