La Sala Jurisdiccional Disciplinaria del Consejo Superior de la Judicatura y las Salas Jurisdiccionales de los Consejos Seccionales de la Judicatura, suspenderán provisionalmente a los funcionarios y empleados judiciales y a los pertenecientes a la Fiscalía General de la Nación, salvo las excepciones constitucionales ya establecidas, una vez oído al servidor judicial que de manera injustificada se abstengan de cumplir con sus funciones.
