ARTICULO 10. Intervención del Juez. El juez reconocerá los beneficios otorgados por la Fiscalía salvo que se hayan violado derechos constitucionales fundamentales del procesado o que exista prueba de que el otorgamiento del beneficio fue determinado por violencia contra el funcionario o por delito cometido por éste. En el evento de que el juez no acepte los beneficios otorgados por la Fiscalía, lo hará mediante auto interlocutorio contra el cual proceden los recursos ordinarios.
