ARTICULO 3o. Naturaleza. El nominador podrá en cualquier tiempo declarar la insubsistencia del nombramiento de un funcionario amparado por derechos de carrera, siempre y cuando medie la indemnización prevista en este Decreto. Para todos los efectos se entenderá que el retiro del servicio mediante la declaratoria de insubsistencia no constituye una sanción para el empleado o funcionario, y que la Indemnización pecuniaria compensa los derechos de carrera.
