Artículo Cuarto. Modalidad culposa en la fuga o evasión. El servidor público o el encargado de la vigilancia, custodia o conducción de un detenido o condenado que por culpa de lugar a su fuga o evasión, incurrirá en prisión de cuatro (4) a ocho (8) años, en interdicción de derechos y funciones públicas por el mismo término.
