Afiliación Al Régimen Subsidiado

Decreto 17 de 2011 · por medio del cual se adoptan medidas en materia de salud con el fin de hacer frente a la emergencia económica, social y ecológica declarada por el Decreto 4580 de 2010.

Afiliación al Régimen Subsidiado. Las personas que en el momento de haber sido afectadas por la emergencia invernal estaban afiliadas al régimen contributivo del sistema de seguridad social en salud, serán afiliadas al régimen subsidiado. Esta afiliación se mantendrá durante un término máximo de seis meses, a quienes acrediten simultáneamente los siguientes requisitos

Haber estado afiliado al régimen contributivo de seguridad social;

Ser residente en los municipios críticamente afectados. Para el efecto, el Ministerio de la Protección Social determinará los criterios de afectación;

Haber perdido la posibilidad de desempeñar su trabajo habitual o el empleo que realizaba con contrato de trabajo. Para tal afiliación no se requerirá la aplicación del instrumento Sisbén. En todo caso se debe garantizar el derecho de libre lección.
