Trámite en segunda instancia. Recibido el expediente, el funcionario de segunda instancia deberá decidir el recurso dentro del mes siguiente, dándole prelación a los casos que estén próximos a prescribir. El funcionario de segunda instancia podrá, únicamente de oficio, decretar y practicar las pruebas que considere indispensables para la decisión, dentro de un término de diez (10) días. Producida la decisión el funcionario del conocimiento lo remitirá inmediatamente al nominador para su eventual revisión.
