La elaboración y calificación de pruebas le corresponde al Procurador General de la Nación cuando se trate de los fiscales de los tribunales, a los fiscales de tribunales las de fiscales de juzgados superiores y de circuito y a los fiscales las de sus empleados. Cuando en un tribunal estuvieren asignados varios fiscales, para estos efectos la coordinación estará a cargo de la Fiscalía Primera.
