Las empresas industriales y comerciales son organismos creados por las Asambleas que desarrollan actividades de naturaleza industrial o comercial, conforme a las reglas del derecho privado, salvo las excepciones derivadas de la ley, y que reúnen las siguientes características

Personalidad jurídica;

Autonomía, y

Capital independiente, constituido totalmente con bienes o fondos públicos comunes, los productos de ellos, o el rendimiento de impuestos, tasas o contribuciones de destinación especial. Las Empresas también podrán ser creadas por los Gobernadores cuando para ello estuvieren precisamente autorizados por las Asambleas.
