El Presidente de la República, los Gobernadores, los Alcaldes y, en general, todos los funcionarios que tengan facultad de nombrar y remover empleados administrativos, no podrán ejercerla sino dentro de las normas que expida el Congreso, para establecer y regular las condiciones de acceso al servicio público, de ascensos por mérito y antigüedad, y de jubilación, retiro o despido. (Articulo 5º del Plebiscito de 1º de diciembre de 1957).
