El Presidente de la República no puede conferir empleo a los Senadores y Representantes principales durante el período de las funciones de éstos ni a los suplentes cuando estén ejerciendo el cargo, con excepción de los Ministros y Viceministros del Despacho, Jefe de Departamento Administrativo, Gobernador, Alcalde de Bogotá, Agente Diplomático y Jefe Militar en tiempo de guerra. La aceptación de cualquiera de aquellos empleos por un miembro del Congreso, produce vacante transitoria por el tiempo en que desempeñe el cargo. (Artículo 109 de la Constitución Política).
