Las actuaciones que se realicen contraviniendo lo dispuesto en los artículos anteriores y las decisiones de autoridades generadas en esas actuaciones, serán nulas. Cualquier persona o el Ministerio Público podrá pedir la declaratoria de esa nulidad ante la autoridad competente. Los contratos que se celebren contraviniendo las disposiciones anteriores carecerán de validez, y no podrán generar pagos. Si éstos se hubieren efectuado, el contratista estará obligado a reintegrar su valor e indemnizar los perjuicios que hubiere causado. Los funcionarios públicos que permitieren la intervención de las personas afectadas por las mismas incompatibilidades, incurrirán en mala conducta, que se sancionará con la destitución.
