º Corresponde al Congreso hacer las leyes. Por medio de ellas ejerce las siguientes atribuciones: (...) 5º Modificar la división general del territorio, con arreglo al artículo 5º de la Constitución; establecer y reformar las otras divisiones territoriales de que trata el artículo 7º, y fijar las bases y las condiciones para la creación de Municipios. (Artículo 76, atribución 5º, de la Constitución Política).
