Si a pesar de los tratamientos previstos o aplicados, el vertimiento ha de ocasionar contaminación en grado tal que inutilice el tramo o cuerpo de agua para los usos o destinación previstos por el Instituto Nacional de los Recursos Naturales Renovables y del Ambiente -INDERENA-, éste podrá denegar o declarar la caducidad de la concesión de aguas o del permiso de vertimiento.
