Las concesiones para alumbrar aguas subterráneas en terrenos ajenos al concesionario solo pueden otorgarse para uso doméstico y abrevadero, previa la constitución de servidumbres y si concurren las siguientes circunstancias

Que en el terreno del solicitante no existen aguas superficiales, ni subterráneas en profundidad económicamente explotable, según su capacidad financiera;

Que ocurra el caso previsto por el artículo 160 de este Decreto, o que el propietario, tenedor o poseedor del predio no ejerza la opción que le reconocen el artículo 159 en el término fijado.
