Con base en los estudios a que se refiere el artículo anterior, el Instituto Nacional de los Recursos Naturales Renovables y del Ambiente -INDERENA-, podrá otorgar el permiso. Si el beneficiario fuere una persona natural o jurídica privada se deberán incluir las siguientes condiciones

Que el área de exploración no exceda de 1.000 hectáreas, siempre y cuando sobre la misma zona no existan otras solicitudes que impliquen reducir esta extensión;

Que el período no sea mayor de un año, y

Que el interesado preste caución de cumplimiento a satisfacción del Instituto Nacional de los Recursos Naturales Renovables y del Ambiente -INDERENA-.
