Establecidas las circunstancias a que se refiere el artículo anterior, el Instituto Nacional de los Recursos Naturales Renovables y del Ambiente -INDERENA-, citará a las partes para que convengan el precio de la zona afectada por la servidumbre y sus modalidades. Si hubiere acuerdo se levantará un acta en la cual se señalarán las condiciones para el pago de la indemnización, para la entrega de la zona afectada y para la ejecución de las obras necesarias, así como sus características.
