Previamente a la constitución de una servidumbre en interés privado a que se refieren los artículos 107 a 118 del Decreto - Ley 2811 de 1974, por la vía jurisdiccional, el Instituto Nacional de los Recursos Naturales Renovables y del Ambiente -INDERENA-, a solicitud de parte y con participación de los interesados, podrá determinar la zona que va a quedar afectada por la servidumbre, las características de la obra y las demás modalidades concernientes al ejercicio de aquella, de acuerdo con el plano que se levante al efecto.
