Se considera igualmente de utilidad pública e interés social, en conformidad con lo dispuesto por el artículo 8 de la Ley 98 de 1928 y por los artículos 1 y 2 del Decreto - Ley 407 de 1949, el establecimiento de servidumbres en la construcción de acueductos destinados al riego y toda clase de trabajos o construcciones para el aprovechamiento, explotación y uso de presas de agua, embalses, obras de regadío, acueductos, así como para el aprovechamiento hidráulico, industrial o agrícola de dichas obras. Para que un predio quede sujeto a servidumbre de acueducto es indispensable que no sea factible conducir el agua económicamente por heredades que pertenezcan al solicitante.
