Para determinar los lugares, la forma de lavado, las condiciones de operación de las naves fluviales o lacustres que transporten sustancias capaces de producir deterioro ambiental, así como para el otorgamiento de licencias de transporte fluvial o lacustre de petróleo o sustancias tóxicas, el Ministerio de Obras Públicas y Transporte tendrá en cuenta, de acuerdo con lo previsto por el artículo 39 del Decreto - Ley 2811 de 1974, las previsiones que al efecto establezcan el Instituto Nacional de los Recursos Naturales Renovables y del Ambiente -INDERENA- y el Ministerio de Salud, y exigirá su cumplimiento por parte de quienes realicen estas actividades.
