EFECTOS PENALES. Quien de cualquier manera tenga conocimiento que se ejecuten obras y trabajos mineros en las condiciones de solicitud de que trata el artículo anterior, deberá dar noticia inmediata al Ministerio para que este, previa verificación de los hechos tome las medidas preventivas a que haya lugar y si se refieren a actividades de explotación, los comunique a la autoridad de instrucción judicial para los efectos previstos en la ley penal.
