DECISION, NOTIFICACION Y RECURSOS. Dentro de los cinco (5) días siguientes a la fecha en que se hubiere practicado la inspección administrativa, el alcalde mediante providencia motivada ordenará al perturbador u ocupante suspender el ejercicio ilegal de las actividades mineras, sus perturbaciones y enviará el expediente al Ministerio para su decisión definitiva. Ejecutoriada ésa, se remitirá a la alcaldía para el lanzamiento respectivo y la remisión de la actuación al juez penal competente, según el caso. Si el perturbador u ocupante exhibiere un título minero vigente, mediante el respectivo certificado del registro minero, de igual categoría al del quejoso, el alcalde suspenderá la actuación, y de oficio remitirá el respectivo expediente al Ministerio para la decisión definitiva.
