OPOSICION DE EXPLOTADORES. En ningún caso podrá oponerse a la expedición de un título minero, quien alegue estar explotando en el área el mineral solicitado. Este explotador sólo podrá, con la intervención del Ministerio, retirar libremente sus maquinarias y equipos, así como las instalaciones que puedan desmontarse sin detrimento de las minas o de sus accesos, y hacerse pagar, por la vía judicial, el valor de las edificaciones y demás inmuebles que vaya a usar el beneficiario del título. Respecto de estos bienes el explotador podrá ejercitar el derecho de retención.
