INDEMNIZACION EN TITULOS Y SOLICITUDES. Cuando haya de expropiarse el derecho a explorar o explotar emanado de un título minero, la indemnización en favor del particular afectado se fijará, teniendo en cuenta solamente el valor de las inversiones realizadas en la exploración, debidamente comprobadas, el valor comercial de las obras, equipos e instalaciones mineras y de servicios, y de dicho valor se deducirá el valor de los minerales extraídos, también por su valor comercial. En el caso de expropiarse obras e instalaciones de explotaciones sin título minero perfeccionado, el monto de la indemnización se establecerá en la forma señalada en el inciso anterior y se contraerá a las obras e instalaciones mineras.
