CLASIFICACION DEFINITIVA. El Ministerio, con fundamento en el Informe Final de Exploración y el Programa de Trabajos e Inversiones, dará la clasificación definitiva del proyecto como de pequeña, mediana o gran minería, sin perjuicio de la obligación del interesado de actualizar los datos del mencionado programa cada cinco años durante la explotación y de la reclasificación que hiciere el Ministerio con base en la información actualizada.
