Cuando la mercancía no se haya podido aprehender, por haber sido consumida, destruida, transformada o porque no se haya puesto a disposición de la autoridad aduanera, procederá la multa de que trata el inciso 1º del artículo 3º del Decreto 1750 de 1991.
